This text is the general information required by article 10 of Ley 34/2002 on information society services and electronic commerce (LSSI-CE). The Spanish version prevails over this English version.

1. Who provides the service

Costa MLS is a property database shared between estate agencies. It is available at mls.costatropicalre.com and is part of Costa Tropical Real Estate.

  • Company name: [COMPANY_LEGAL_NAME]
  • Tax ID (NIF / CIF): [CIF]
  • Registered address: [REGISTERED_ADDRESS]
  • Contact e-mail: [CONTACT_EMAIL]

You can write to that address with any question about the service or about these texts.

2. Registry data and authorisations

Mercantile Registry (Registro Mercantil) data: [REGISTRY_DATA]

[ABOGADO: Which Registro Mercantil details must appear here (volume, folio, sheet, entry), and must a registration number in any regional register of estate agents or agencies, or in a professional body, also be shown if the rules of Andalusia require it?]

3. The operator is also a member agency

[COMPANY_LEGAL_NAME] is not a neutral third party. It is also a member agency of Costa MLS and publishes its own properties on it, like any other agency. We say so, so that every agency knows it before joining.

The service does not intermediate in deals between agencies. Each agency agrees terms with the others on its own account.

4. Purpose and access

Costa MLS is a service for professionals only. It is not a public portal for buyers. Only agencies that we have reviewed and approved can sign in. Access to the service is free of charge for member agencies.

The terms of use set out the rights and duties of agencies. This legal notice does not replace them.

5. Content and responsibility

Each agency is responsible for the listings it publishes and for making sure they are accurate and lawful. Costa MLS does not check every listing one by one.

To the extent that we are a hosting provider, we are not liable for the information that agencies store in the service as long as we have no actual knowledge that it is unlawful. If we do have such knowledge, we act diligently to remove it or block access to it (article 16.1 of Ley 34/2002).

[ABOGADO: Is Costa MLS a hosting provider for the purposes of article 16.1 of Ley 34/2002, or is its role closer to that of a publisher, given that it generates an export feed with other agencies' listings for member agencies to show on their own websites?]

6. How to report unlawful content

If you believe a listing or other content is unlawful, write to [CONTACT_EMAIL]. Say where the content is, why you think it is unlawful and how we can contact you. This is the notice mechanism provided for in article 16 of Regulation (EU) 2022/2065.

7. Data protection and cookies

The processing of personal data is explained in the privacy notice. The use of cookies is explained in the cookie notice. Both are available in Spanish and in English.

8. Governing law and language

This legal notice is governed by Spanish law. The Spanish text is the authoritative one. The English version is a faithful translation offered as a convenience.
